1. Acceptance of these terms

These Terms & Conditions (“Terms”) are an agreement between you and TechKhedut Inc. (“TechKhedut”, “we”, “our” or “us”) for your use of GPS Field Area Measurement (the “App”). By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian, who agrees to these Terms on your behalf.

3. Licence to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, in line with these Terms and the usage rules of the store you downloaded it from. You may use the App and the measurements, files and photos you create with it for personal or work purposes, such as farming, property, construction or field inspections.

You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, decompile or attempt to extract the source code of the App, except where applicable law expressly permits it.

4. Pro subscription & free trials

• The App is free to download. GPS Field Area Measurement Pro is an optional auto-renewing subscription that unlocks additional features shown in the App and an ad-free experience. Pro features may change over time.
• Prices, billing periods and any free-trial length are shown in the App and in the App Store or Google Play before you buy, and may vary by country.
• Payment is charged to your Apple ID or Google Play account when you confirm the purchase, or when a free trial ends.
• Auto-renewal: your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before it ends.
• Free trials: if you do not cancel at least 24 hours before a trial ends, it converts into a paid subscription. Any unused part of a trial is forfeited when you buy a subscription, where applicable.
• Cancel or manage your subscription in your App Store or Google Play account settings at any time. Cancelling stops future renewals, and you keep Pro until the end of the period you have already paid for. Deleting the App does not cancel a subscription.
• Refunds: subscription payments are non-refundable once a billing period has started, except in the exceptional cases described in our Refund & Cancellation Policy. App Store refunds are processed by Apple; Google Play refunds are processed through Google Play.
• Use Restore Purchases in the App to restore an active subscription on a new or reinstalled device signed in to the same store account.

5. Advertising

The free version of the App shows advertisements from third-party ad networks. We are not responsible for the content of third-party ads or for products, services or websites they link to. See the Privacy Policy for how ads use data and how to manage your choices.

6. Measurement accuracy — not a land survey

• Areas, distances, perimeters, radii and routes are calculated from the points you place on the map. Their accuracy depends on how precisely you place those points, the zoom level, and the accuracy and alignment of the map imagery.
• GPS readings, including coordinates, elevation, compass heading and photo stamps, depend on your device's hardware, calibration, satellite signal and surroundings, including tree cover, buildings and magnetic interference. Readings are approximate; the accuracy shown in the App (for example ±4 m) is an estimate.
• Unit and coordinate conversions are calculated mathematically and may be rounded for display.
• Measurements from the App are estimates for general and planning purposes only. They are not a legal, cadastral or professional land survey and must not be relied on as the sole basis for property sales, purchases, registration, boundary disputes, legal proceedings, government or subsidy applications, or construction that requires certified measurements. Use a licensed surveyor where an official measurement is required.

7. Maps, imagery & third-party data

• Map tiles, satellite and terrain imagery, place names, addresses and elevation data are provided by third-party sources. They may be incomplete, out of date, misaligned, low-resolution in some areas, or temporarily unavailable, and satellite imagery may not show current field boundaries, crops or structures.
• Addresses and place names shown on photo stamps or saved locations are looked up from coordinates and may be approximate.
• Your use of third-party content may also be subject to that provider's own terms and attribution requirements.

8. Offline maps

• Offline maps let you view a downloaded area without a mobile connection. Downloads use your device storage and data allowance; we recommend downloading over Wi-Fi.
• Offline map data reflects the imagery available when you downloaded it, may need to be updated, and may be limited in size, detail or availability by our map providers.
• GPS positioning works without mobile data, but features that need the internet, such as loading new map areas, address lookups or ads, are not available offline.

9. Imported & exported files

• You are responsible for the files you import, including making sure you have the right to use them. Files that are malformed, very large or use unsupported features may not import completely or correctly.
• Exported files are provided in standard formats (such as KML, KMZ, GPX, GeoJSON, PDF and SVG). How they display in other apps, GPS devices or GIS software depends on that software, and we do not guarantee compatibility with any particular product.
• Measurements, saved files, offline maps and photos are stored on your device. You are responsible for backing up anything you want to keep; we cannot recover data that is deleted from your device or lost when you uninstall the App or change devices.

10. Safety in the field

• Stay aware of your surroundings when using the App outdoors. Watch for traffic, uneven ground, water, livestock, machinery and other hazards, and do not walk into unsafe areas to place a point or take a photo.
• Do not use the App while driving or operating vehicles or machinery, including tractors and farm equipment.
• The App is not designed for emergency services, aviation, marine, military or other safety-critical navigation, and must not be relied on for those purposes.

11. Property, photos & lawful use

• Do not enter private or restricted land without permission in order to measure or photograph it. Measuring land on a map does not give you any right to access, use or claim it.
• Respect privacy and local laws when taking photos or recording locations, and do not photograph restricted or prohibited areas.
• Do not use the App to track, monitor or locate another person without their knowledge and consent.
• Measurements, files, photos and notes you create are yours. You are responsible for how you use and share them.

12. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• interfere with, disrupt or attempt to gain unauthorised access to the App, its services or its data providers;
• bulk-download, scrape, resell or commercially redistribute map tiles or imagery, except as the App allows;
• use bots, scripts or automated means to access the App or its services;
• remove or alter any copyright, trademark or map attribution notices.

13. Intellectual property

The App, including its design, code, text, graphics, icons and the “GPS Field Area Measurement” name and logo, is owned by TechKhedut or its licensors and is protected by intellectual property laws. Map data and imagery belong to their respective owners. These Terms do not give you any rights to our trademarks or content beyond the licence above.

14. Privacy

Our Privacy Policy explains what information the App processes and how you can control it, including location, permissions, files, advertising and analytics.

15. Disclaimers

To the fullest extent permitted by law, the App and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the App will be uninterrupted, error-free or free of harmful components, or that any data, including location, measurement, elevation, map or imagery data, will be accurate, current or complete.

16. Limitation of liability

To the fullest extent permitted by law, TechKhedut and its affiliates, officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, crops, property, time or goodwill, arising from or related to your use of, or inability to use, the App, including reliance on measurements, boundaries, coordinates, elevation, map imagery or exported files.

Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid for Pro in the 12 months before the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.

17. Indemnity

You agree to indemnify and hold harmless TechKhedut from any claims, damages, losses and expenses, including reasonable legal fees, arising from your misuse of the App, your reliance on its measurements in place of a professional survey, or your violation of these Terms or of any law or third-party right.

18. Termination

You may stop using the App at any time by uninstalling it; remember to cancel any active subscription through your store account and to save any files you want to keep. We may suspend or end your access to the App, or to any feature, if you breach these Terms or if we discontinue the App. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnity and governing law, will survive.

19. Apple App Store & Google Play terms

If you downloaded the App from the Apple App Store, you and TechKhedut acknowledge that:

• these Terms are between you and TechKhedut only, not Apple, and TechKhedut, not Apple, is solely responsible for the App and its content;
• your licence is limited to using the App on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
• Apple has no obligation to provide maintenance or support for the App;
• if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the App;
• TechKhedut, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection and intellectual property infringement claims;
• you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties;
• you must comply with applicable third-party terms, such as your wireless data service agreement, when using the App;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. Where these Terms conflict with an app store's terms, the store's terms apply to the extent of the conflict.

20. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights you have in your country of residence, the courts of Rajkot, Gujarat, India will have exclusive jurisdiction over any dispute relating to these Terms or the App.

21. Changes to these terms

We may update these Terms from time to time. We will post the updated version on this page with a new “Last updated” date and, for material changes, let you know in the App. Continuing to use the App after changes take effect means you accept the updated Terms.
